These general terms of use (the 'Terms') set out the rules for accessing and using the oPaddock application and website. By creating an account or using the service, you accept these Terms.
1.Purpose of the service
oPaddock is a platform gratuite of mise en relation between, on the one hand, riders and horse owners and, on the other hand, professionals and businesses of the equine sector offering facilities: horse accommodation, rental of stalls, paddocks, outdoor arenas, indoor arenas, solariums or any other equestrian facility. oPaddock also provides a tool for book online these facilities, as well as features for recording and viewing Ride trails and for postingReviews.
2.Publisher and host
Publisher: Equimondo, a limited liability company with capital of 1,000 EUR, registered office: 1 avenue des Essarts, 14470 Courseulles-sur-Mer, France. SIREN 824 571 145, Caen Trade and Companies Register, VAT FR47 824 571 145. Publication director: Sébastien Pesquerel. Contact: hello@opaddock.com.
Host: OVH SAS, a simplified joint-stock company registered with the Lille Métropole Trade and Companies Register under number 424 761 419, whose registered office is at 2 rue Kellermann, 59100 Roubaix, France (chairman: Michel Paulin). Data hosted in France.
3.Definitions
- Utilisateur : any person using oPaddock.
- rider : user looking for or booking an equestrian facility.
- Professionnel or Structure : user offering one or more facilities.
- Annonce : the listing published by a professional describing a facility.
- Booking : the request for, or the confirmation of, the occupancy of a facility through the oPaddock tool.
- Trail : a ride route recorded or viewed through the application.
- Reviews : the assessment left by a user about an accommodation or a trail.
4.Access and free use
Access to oPaddock and all its features are gratuits for all users. oPaddock takes no commission on bookings or on any payments. Access to the service requires an internet connection, the cost of which is borne by the user.
5.Account and registration
Some features require an account. You undertake to provide accurate information and keep it up to date, and to keep your credentials confidential. You are responsible for what is done from your account.
Age: the application may be used by minors. A minor under 16 ans may only create an account with the consent of a holder of parental authority. Booking a facility is reserved for people of full age (18 and over).
6.Role of oPaddock: an intermediary
oPaddock does not take part in the contractual relationship between users and cannot be held liable for a dispute between a rider and a professional.
7.Online booking
The booking tool lets a rider send a request to a professional and, where applicable, confirm an occupancy. The booking binds the rider and the professional under the latter's own conditions (availability, house rules, cancellation terms). oPaddock merely provides the technical tool for connecting and booking.
8.Paiement
oPaddock receives no payment and takes no commission. When a professional has enabled online payment, card payment is handled by an external payment provider that they have chosen themselves (for example Stripe, HelloAsso or Stancer).
9.Professionals' obligations
- Publish accurate, up-to-date listings and keep availability current;
- Hold the authorisations, insurance and compliance required for their activity and for hosting horses;
- Comply with the applicable rules (health, animal welfare, safety, tax);
- Honour accepted bookings and welcome riders under the conditions announced;
- Set out and communicate their own conditions (prices, cancellation, house rules).
10.Riders' obligations
- Provide accurate information when making a request or a booking;
- Respect the premises, the house rules and the professional's instructions;
- Ensure their horses are up to date with their health requirements;
- Hold the appropriate insurance.
11.Ride trails
The application lets you record your own trails and view those shared by other users. These trails are provided for information only. oPaddock does not guarantee that a trail is passable, safe or lawful. Users follow a trail at their sole risk.
12.Reviews
Reviews must be honest, based on a real experience, and free of unlawful, insulting, defamatory or misleading remarks.
A review of a Accommodation may only be posted by a user who has actually made a booking of that accommodation through oPaddock. A review of a Trail may be posted by any user who has an account.
Reviews are not edited by oPaddock and are sorted by default from the most recent to the oldest. No consideration is paid in exchange for posting a review.
13.User content
You keep your rights over the content you publish (texts, photos, trails, reviews). You grant oPaddock a free, non-exclusive licence to host, display and distribute that content as part of the service. You warrant that you hold the necessary rights over the content you publish.
14.Intellectual property
The 'EQUIMONDO' trade mark, the 'oPaddock' trade mark, the application, its code, its visual identity and its own content are protected and remain the property of Equimondo. Any unauthorised reproduction or use is prohibited.
15.Liability
oPaddock fournit un service de mise en relation et de réservation avec diligence, mais ne garantit pas une disponibilité ininterrompue du service ; n'est pas responsable des contenus publiés par les utilisateurs ni des relations nouées entre eux ; n'est pas responsable de l'inexécution ou de la mauvaise exécution d'une prestation par un professionnel. Les présentes clauses ne limitent pas les droits que la loi reconnaît aux consommateurs.
16.Personal data

17.Term and termination
The terms of use apply for the whole time the service is used. You may close your account at any time. oPaddock may suspend or close an account in the event of a breach of these terms, after informing the user except in an emergency or where required by law.
18.Amendment of the terms of use
oPaddock may amend these terms of use. Users are informed of significant changes by an appropriate means. Continued use of the service constitutes acceptance of the current terms.
19.Applicable law and disputes
These terms of use are governed by French law. In the event of a dispute, an amicable solution will be sought first, by sending a written complaint to Equimondo (hello@opaddock.com). The consumer retains the benefit of the mandatory protective provisions of the country in which they reside.
For a cross-border dispute within the European Union, the consumer may contact the European Consumer Centre of their country of residence.
Failing an amicable settlement, the dispute will be brought before the competent courts in accordance with the applicable rules.
